These Terms of Use govern your access to and use of govianenergy.com (the “Site”), operated by Govian Energy LLC. By using the Site you agree to these terms. If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful purposes only. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access to any system, or use automated means to extract content in a way that burdens our infrastructure.
Information on the Site is not an offer
Content on the Site is provided for general information about Govian Energy and its services. Descriptions of partnership models, charging programs, investment structures and revenue sharing are illustrative. They are not an offer, commitment, financing commitment, or guarantee of availability, funding, pricing, revenue or return. Any Govian investment in a charging project, and all ownership, installation, pricing and revenue-sharing terms, depend on property qualification, site evaluation, project economics and a final written commercial agreement.
Charging services
Access to EV charging is available at supported Govian charging locations only. Govian does not guarantee that any charger will be available, operational or capable of delivering a particular charging rate at a particular time. Charging services are governed by the charging terms presented at the time of the charging session and by the applicable agreement with the relevant property, which take precedence over these Terms of Use for those services.
Pricing
Charging pricing varies by location and by the commercial arrangement applicable to that location. Pricing shown during a charging session applies to that session.
Intellectual property
The Site and its content, including text, graphics, logos, the Govian Energy name and marks, and the Govian Charge Cloud platform, are owned by Govian Energy LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce or create derivative works from the Site without permission, except for ordinary personal or internal business reference.
Third-party links and services
The Site may link to or rely on third-party websites and services. Govian does not control and is not responsible for their content, availability or practices.
Disclaimer
The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Govian does not warrant that the Site will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the maximum extent permitted by law, Govian Energy LLC and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenues, data or business opportunities, arising out of or relating to your use of the Site, however caused and under any theory of liability.
Indemnification
You agree to indemnify and hold harmless Govian Energy LLC from claims, losses and expenses arising out of your misuse of the Site or violation of these terms.
Governing law
These Terms of Use are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws rules. Any dispute arising from these terms or the Site will be brought in the state or federal courts located in Oklahoma County, Oklahoma.
Changes
We may revise these Terms of Use from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
